Terms of Service

1. Acceptance of Terms

By engaging RK Gypsum ("Company," "we," "us," or "our") for ceiling installation, repair, or related services, you ("Customer," "you," or "your") agree to be bound by these Terms of Service. These terms constitute a legal agreement between you and RK Gypsum.

2. Services Offered

RK Gypsum provides the following services in Hyderabad and surrounding areas:

  • Gypsum ceiling installation and repair
  • False ceiling installation and maintenance
  • POP (Plaster of Paris) ceiling work
  • Ceiling repair and restoration services
  • Emergency ceiling repair services
  • Free consultation and site surveys

3. Service Agreements and Quotations

3.1 Quotations

  • All quotations are valid for 30 days from the date of issue
  • Prices are inclusive of materials, labor, and applicable taxes unless stated otherwise
  • Final pricing may vary based on actual site conditions discovered during installation
  • Any changes to the original scope of work will be documented and agreed upon before implementation

3.2 Service Agreements

  • Written agreements must be signed before commencement of work
  • Work schedules and timelines will be mutually agreed upon
  • Any modifications to the agreement must be in writing and signed by both parties

4. Payment Terms

4.1 Payment Schedule

  • For projects over ₹50,000: 40% advance, 40% at midpoint, 20% on completion
  • For projects under ₹50,000: 50% advance, 50% on completion
  • Emergency repairs: Payment due upon completion of work

4.2 Payment Methods

  • Cash, bank transfer, UPI, or cheque payments accepted
  • All payments must be made in Indian Rupees (INR)
  • Late payment charges of 2% per month may apply on overdue amounts

5. Customer Responsibilities

  • Provide safe and unobstructed access to work areas
  • Ensure availability of electrical power and water if required
  • Remove or protect valuable items from work areas
  • Inform us of any structural issues or building restrictions
  • Obtain necessary building permits if required by local authorities
  • Provide accurate measurements and specifications
  • Be present or designate an authorized representative during site visits

6. Warranties and Guarantees

6.1 Workmanship Warranty

  • 6-month warranty on all new installations
  • 3-month warranty on repair and maintenance work
  • Warranty covers structural defects and installation-related issues

6.2 Material Warranty

  • Materials are covered under manufacturer's warranty terms
  • We will assist with warranty claims for defective materials

6.3 Warranty Exclusions

  • Damage caused by water leaks from external sources
  • Normal wear and tear
  • Damage due to building settlement or structural movement
  • Modifications made by other contractors
  • Accidental damage or misuse

7. Limitation of Liability

  • Our liability is limited to the value of work performed under the specific contract
  • We are not liable for indirect, consequential, or incidental damages
  • We maintain appropriate insurance coverage for our operations
  • Claims must be reported within 30 days of discovery

8. Cancellation and Termination

8.1 Customer Cancellation

  • Cancellation before work begins: Full refund minus 10% processing fee
  • Cancellation after work begins: Charges for completed work plus material costs
  • Custom-ordered materials may not be refundable

8.2 Company Termination

  • We may terminate for non-payment or breach of agreement
  • We may terminate if site conditions are unsafe
  • Refunds will be provided for work not completed

9. Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our control, including but not limited to natural disasters, government actions, labor strikes, or material shortages.

10. Privacy and Data Protection

  • Customer information is handled according to our Privacy Policy
  • We may use project photos for marketing purposes with customer consent
  • Personal data is stored securely and not shared with third parties without consent

11. Intellectual Property

  • All custom designs and specifications remain our intellectual property
  • Customers may not reproduce our designs for other projects without permission
  • We respect third-party intellectual property rights

12. Dispute Resolution

12.1 Informal Resolution

We encourage customers to contact us directly to resolve any disputes or concerns.

12.2 Formal Resolution

  • Disputes will be resolved through arbitration under Indian Arbitration laws
  • Arbitration will be conducted in Hyderabad, Telangana
  • The courts of Hyderabad will have exclusive jurisdiction

13. Governing Law

These terms are governed by the laws of India and the state of Telangana. Any legal proceedings will be subject to the jurisdiction of courts in Hyderabad.

14. Modifications to Terms

  • We reserve the right to modify these terms at any time
  • Updated terms will be posted on our website
  • Existing contracts will be governed by the terms in effect at the time of signing
  • Continued use of our services after changes constitutes acceptance

15. Severability

If any provision of these terms is deemed invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
